What this Agreement Covers
Indigo Socks, LLC ("we", "our", or "us") operates the website located at oursock.com (“Website”). This Agreement governs your use of the Website and the oursock.com service (“Service”). The Service permits customers that have an appropriate relationship with any organization to design and purchase custom merchandise properly describing that relationship. You understand that by using the Website and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Website and the Service solely as provided in this Agreement.
The Privacy Policy discloses our practices related to personal information collected through the Website. The Privacy Policy also covers personal information that we may collect and process separate and apart from the Website, such as through email or other means. By providing personal and other information to us or through your use of our Website or Services, you agree to the terms and conditions of this Privacy Notice.
Intellectual Property Rights of oursock.com and Third Parties
We are committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, written and other materials that appear on the Website (collectively the “Contents”) are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by Indigo Socks, LLC.
Any materials submitted by you, including, without limitation, photographs, videos, images, text, graphics and other materials (collectively, “User Submissions”) are subject to the following terms and conditions: (i) you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions with respect to the User Submissions, and that the User Submissions do not and will not infringe, misappropriate, use or disclose without authorization or otherwise violate any copyright, trademark, trade secret right or other intellectual property or other property right of any third party, and that the User Submissions are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, confusingly similar to brands or branded products sold by others or otherwise objectionable.
Designs created using the Services are in no way the exclusive property of the customers who request such designs. Indigo Socks, LLC retains the right to display such designs or offer them (or derivatives of such designs) to other customers. By using our Services, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, prepare derivative works of, and display the designs in connection with the Website and our business, including without limitation for promoting the Services in any media formats and through any media channels.
We may use the designs created using the Services to train and develop artificial intelligence (AI) models. This use may include, but is not limited to, improving the performance, capabilities, and efficiency of our AI systems. Designs created using the Services may be used in various stages of AI development and for different purposes within the scope of our business operations
We may use the designs created using the Services for the purpose of marketing and advertising. This includes but is not limited to displaying the designs in our marketing materials, on our website, or in other media used for our business purposes.
Privacy Policy
We are committed to protecting the privacy and confidentiality of information and data of our customers and Website users. We will not give or sell anyone specific information about you or any orders you have placed through our Services except that: (i) we may share information about you or an order that you have placed with a relevant Institution in order to allow such Institution to review the use of the Licensed Marks as necessary; (ii) we may provide information about you or an order that you have placed with our subcontractors; and (iii) we may provide information about you or an order that you have placed with our marketing partners and affiliates for the purposes of marketing our Website and our Services. In addition, we may share information about you or an order that you have placed if we believe in good faith that disclosure of specific information is necessary to (a) resolve disputes, investigate problems, or enforce our User Agreement; (b) comply with relevant laws or respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity (in which case we can, and you authorize us to, disclose personal information without subpoenas or warrants served on us); or (c) protect and defend our rights or property or the rights and property of you or third parties. The Website employs third party cookies which are used to target customers for advertising purposes. We collect information (including email addresses) that allows us, among other things, to: process and fill your order; contact you regarding the processing of your order; share your design with those whom you request; improve our website and service; and send informative and promotional emails that may be of interest to you.
As we expand and improve the Website and Services, we may need to modify this Privacy Policy from time to time without prior notice. We encourage you to review this Privacy Policy on a regular basis for any changes.

Refund Policy
Once an order has been moved into full production, we can no longer accept returns or refunds. If you would like to request a refund, you must do so before approving the pre-production images. In specific cases, we may be able to give a partial refund of 80%.
Limit of Indigo Socks, LLC’s Responsibility
The information and materials contained in the Website, including text, graphics, links or other items, are provided “as is”, “as available”. We do not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaim liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials.
In no event will Indigo Socks, LLC or any of its subsidiaries, affiliates, employees, contractors, suppliers or other representatives be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages (be they direct, indirect, punitive, special, consequential or otherwise), losses or expenses arising in connection with use of the Website or Services, unless otherwise expressly agreed in writing and pursuant to a separate written contract concerning the purchase by you of Services contemplated herein. This limitation of liability includes liability for lost profits, business interruption, loss of information or data, data breach, or loss of goodwill, loss of or damage to property, and any claims made by third parties arising out of or in connection with the use of this Website or Services regardless of whether we have been advised, knew, or should have known of the possibility thereof. Moreover, you shall indemnify and defend Indigo Socks, LLC, its affiliates, subsidiaries, employees, contractors and other representatives from all claims and expenses that arise out of or in connection with your use of the Website or Services in breach of this agreement or your violation of any laws or regulations of the rights of third parties.
Intellectual Property Claims
We have a policy of removing designs that violate copyright, trademark, or other intellectual property laws, suspending or blocking access to features of our Website to any user who uses our Website or Services in violation of any such law. Pursuant to Title 17 of the United States Code, Section 512, we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with such law. If you believe your copyright, trademark, or other intellectual property right is being infringed by a customer of Indigo Socks, LLC, please provide written notice to the following agent for notice of claims of infringement:

In order for us to respond to your notice, it must: (i) contain your physical or electronic signature; (ii) identify the copyrighted work, trademark, or other intellectual property alleged to have been infringed; (iii) identify the allegedly infringing material in a sufficiently precise manner to allow us to locate that material; (iv) contain adequate information by which we can contact you (including postal address, telephone number, and e-mail address); (v) contain a statement that you have a good faith belief that use of the copyrighted material, trademark, or other intellectual property is not authorized by the owner, the owner’s agent, or the law; (vi) contain a statement that the information in the written notice is accurate; and (vii) contain a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright, trademark, or other intellectual property right owner.
Indemnity
You agree to defend, indemnify and hold Indigo Socks, LLC and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys’ fees, arising from or relating to your use of the Website and the Service, your violation of this Agreement, or your violation of any rights of another.
Governing Law
This Agreement shall be governed by the laws in the state of Connecticut and, where applicable, by federal law.
